Mr. Kirti Sharan Agarwal, learned counsel for the petitioner. 2. None appears for the respondents. 3. By the instant petition the petitioner is praying for the following reliefs: i. Issue a writ, order or direction in the nature of mandamus commanding the Assistant Collector, 1st Class/Pargana Adhikari, Kaushia Kutoli, District Nainital to prepare the final scheme of partition in accordance with the preliminary decree dated 29.01.2025 and law at the earliest and within such time as this Hon’ble Court may fix for the same; in Suit No. 22/1 of 2017-18; Anil Kumar Bhatt vs. Pushkar Bhatt and Others. ii. Award cost of this petition to the petitioner against the respondents. 4. It is argued by the learned counsel for the petitioner that the final decree was prepared on 29.01.2025 but the final scheme of partition in accordance with the preliminary decree dated 29.01.2025 has not been prepared. 5. The relief as sought appears to be innocuous. 6. In such view of the matter, the instant writ petition is disposed of finally with the direction to the Assistant Collector, 1st Class/Pargana Adhikari, Kaushia Kutoli, District Nainital, to prepare a final scheme of partition in accordance with the preliminary decree dated 29.01.2025 passed in Suit No. 22/1 of 2017-18 ‘Anil Kumar Bhatt vs. Pushkar Bhatt and Others’ as early as possible preferably within six weeks from the date of presentation of certified copy of this order.
