And In Re : Sahin Molla ... Petitioner. Mr. Kallol Kumar Basu, Mr. Md. Jannat Ul Firdous, Mr. Rajsekhar Hota ... For the Petitioner. Mr. Md. Adil Badr, Mr. Tirupati Mukherjee ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years 2 months and only five witnesses, till date, have been examined out of 25 witnesses proposed by the prosecution. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and refers to the evidence of the mother of the victim who in cross-examination acknowledged the fact that in order to save the accused, the deposition was made in court in a convenient way. There are statements under Section 164 of the Code of Criminal Procedure as well as medical evidence. Having regard to the fact that there are materials against the accused, as a matter of last chance, I grant 2 opportunity to the prosecution to complete the evidence of rest of the witnesses within a period of six months from the next date fixed. Petitioner would be at liberty to approach this Court after the aforesaid time period is over. At this stage, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 12 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
