P.P. ------ Order No.02 Dated- 12.08.2026 Heard the parties. The petitioner has been made accused in connection with Sitaramdera P.S. Case No.157 of 2025 corresponding to G.R. Case No.426 of 2026 (S.T. No.160 of 2026) registered for the offences punishable under Section 103 (1), 61 (2), 3 (5) of the B.N.S., 2023 and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons and in criminal conspiracy with them, has committed the murder of Shekhar Sandil. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner along with co-accused Rahul Singh, Dablu Singh were seen running towards the Basti and on the suspicion that the petitioner might have committed the murder of Shekhar Sandil, he has been implicated in this case. It is further submitted that though charge has already been framed in this case but no witness has been examined as yet. It is also submitted that the main allegation is against co-accused-Rahul Singh who was seen fleeing with the pistol immediately after the occurrence but the only allegation against the petitioner is that he was also seen running with the co-accused-Rahul Singh. It is further submitted that there is specific allegation that the deceased was in inimical terms with the co-accused-Rahul Singh but no such allegation is there against the petitioner. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is next submitted that the petitioner has been in custody since 13.12.2025 as has been mentioned in para-10 of the instant bail application. It is lastly submitted that the co-accused person with similar allegation has already been admitted to bail by this Court vide order dated 30.06.2026 in B.A. No.5914 of 2026. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Jamshedpur in connection with Sitaramdera P.S. Case No.157 of 2025 corresponding to G.R. Case No.426 of 2026 (S.T. No.160 of 2026) with the condition that he will cooperate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
