JUSTICE V SRISHANANDA ORAL ORDER Joint memo is filed which reads as under: “The Petitioner and the Respondent respectfully submit as follows: 1. The Petitioner and the Respondent submit that on dated 14.03.2018, the small cause and 27th ACMM, at Bangalore in C.C. No.4584 of 2016 has passed an order for alleged offence punishable Under Section 138 of Negotiable Instruments Act by which the Petitioner is sentenced to pay fine of Rs.6,50,000/- and she shall undergo simple imprisonment for six months. Which order was challenged by the Petitioner and filed the appeal before the Hon'ble Court of LXII Additional City Civil Judge, Bangalore in Criminal Appeal No.657 of 2018, judgment and decree dated 08.04.2022, which court has confirmed the said order. - 3 - HC-KAR NC: 2026:KHC:17903 CRL.RP No. 1249 of 2022 2. Being aggrieved by the said judgment the present revision petition is filed by the Petitioner 3. During the pendency of the above proceedings, the parties have amicably settled the dispute out of court without coercion or undue influence. 4. As per the settlement the Petitioner has agreed to pay a sum of Rs.5,50,000/- (Rupees Five Lakhs and fifty Thousand Only) towards full and final settlement. The Respondent has agreed to the said amount. 5. It is agreed between the parties the payment shall be made as per the agreed schedule: Compensation Amount Settlement Amount Rs.6,40,000 Rs.5,50,000 Total deposited amount (Rs.65,000+ Rs.1,95,000/-) on 01.08.2017 and 23.01.2023 Rs.2,60,000 Balance Rs. 2,90,000 6. The Petitioner has paid a sum of Rs.1,00,000/- to the Respondent by way of demand draft bearing No.039153 dated 23.03.2026. 7. The Balance sum of Rs 1,90,000/- (One lakh Ninety Thousand) shall be paid by the Petitioner to the Respondent in two Instalments: - 4 - HC-KAR NC: 2026:KHC:17903 CRL.RP No. 1249 of 2022 a. Rs.1,00,000/-on dated 23/04/26 b. Rs. 90,000/-on dated 23/05/26 8. The Respondent/Complainant submits that he has no objection to compounding the offence in view of Section 147 of the Negotiable Instruments Act, 1881, subject to receipt of the balance settlement amount of INR 2,90,000/- from the Petitioner. 9. The Petitioner has no objection to the Respondent withdrawing the deposited amount of INR 2,60,000/- from the Learned Trial Court. 10. The parties pray that this Hon'ble Court may be pleased to: Record this compromise Permit compounding of the offence Set aside the conviction and sentence passed by the courts below Acquit the Petitioner/Accused, subject to the Petitioner's compliance with its payment obligations set out hereunder to the Respondent. Balance of the fine amount is to be paid by the petitioner on the due date without fail. Any default in any one of the instalment would automatically restore the sentence of imprisonment ordered by the learned Trial Magistrate, confirmed by the First Appellate Court in respect of petitioner No.2/accused No.2. 5. After payment of entire compensation amount as agreed, sum of Rs.10,000/- imposed by the learned Trial magistrate, confirmed by the First Appellate Court towards defraying expenses of the State stands set aside.
