THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: (i) ISSUE a writ of mandamus or any other writ, order or direction, directing the respondent No.2 to consider the representation of petitioner dated 26.03.2025 produced at Annexure-E in terms of this Hon'ble court order dated W.P.No.46302/2018 03.09.2022 and order in dated 28.05.2024 in W.P. No. 26881/2023 which is placed at Annexure-F & G respectively, in the interest of justice and equity; (ii) ISSUE a writ of mandamus or any other writ, order or direction, directing the respondent No.2 to release payments to the Petitioner against the Bills submitted on 17.01.202& 10.01.2025 as per Annexure-D and D1 series forthwith with interest as deems fit by this Hon'ble Court, to meet the ends of justice and equity; iii) GRANT such other order or direction as deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity. - 3 - HC-KAR NC: 2026:KHC:29316 WP No. 13342 of 2025 2. The grievance of the petitioner is that the petitioner being the successful bidder in terms of tender notification issued, an agreement came to be entered into between the petitioner and the respondent on 21.03.2023, pursuant to which the petitioner having rendered services had raised his running bills which have not been paid. Hence, the petitioner submitted a representation on 26.03.2025 which is also not been considered and no payment has been made. It is in that background that the petitioner is before this Court. 3. Whenever any bills are raised by a contractor and an agreement entered into between a State or its entities, it is but required for the authorities to consider the said bills in terms of the agreement, work order etc. and pass necessary orders within a reasonable period of time. 4. In the present matter, representation submitted on 26.03.2025 has been pending for more than a year. In that view of the matter, I pass the following: ORDER i) The Writ Petition is allowed. ii) The respondents are directed to consider representation of the petitioner dated - 4 - HC-KAR NC: 2026:KHC:29316 WP No. 13342 of 2025 26.03.2025 within a period of six weeks from the date of receipt of copy of this order. 5.
