The petitioner is apprehending her arrest in connection with Kisko P.S. Case No. 28 of 2022, registered for the offence under Sections 379 and 411 of the Indian Penal Code, Rule-4/54 of Jharkhand Minor Mineral Concession Rules, 2004, Section 4/21 of the Mines and Minerals (Development and Regulation) Act, 1957, pending in the court of learned Judicial Magistrate, 1st Class, Lohardaga.

Learned counsel appearing for the petitioner submits that the petitioner being a lady and happened to be the owner of a tractor and allegations are made of carrying 80 CFT sand on the said tractor. He next submits that the occurrence was said to be occurred on 10.09.2022, wherein the FIR has been registered on 16.09.2022. He also submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-11 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that illegally the sand was being carried on the tractor in question.

Considering that the petitioner is a lady and the owner of the tractor in question and further she is having no criminal antecedent and disclosure to that effect has been made in para-11 of the petition and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Lohardaga, in connection with Kisko P.S. Case No. 28 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
