JUSTICE D K SINGH) The present appeal under Section 19(1) of the Family Courts Act, 1984 r/w Section 28(1) of the Hindu Marriage Act, 1955, has been filed by the appellant-wife impugning the judgment and decree dated 17.11.2022 passed by the IV Addl. Principal Judge, Family Court, Bangalore, in M.C.No.4636/2016 instituted by the respondent-husband seeking dissolution of marriage under Section 13(1)(ia) of the Hindu Marriage Act, 1955. 2. The marriage was performed between the parties on 29.06.2015. The marriage survived little more than a year and thereafter, the parties started living separately. The parties have not lived together for almost a decade. 3. The learned Family Court vide the impugned judgment has dissolved the marriage performed between - 3 - HC-KAR NC: 2026:KHC:29281-DB MFA No. 833 of 2023 the parties. However, no order as to permanent alimony has been passed. 4. Ms.Prathima S.K., learned counsel appearing for the appellant-wife does not have much contention regarding the decree of divorce. However, she submits that appellant started living separately because of the conditions and situation created by the husband. In fact, she was forced to live separately from the husband and therefore, the decree of divorce without permanent alimony/maintenance is not justified. She further submits that the parents of the appellant had incurred huge expenses in marriage and the marriage did not last for long. 5. Sri.Srinivas V., learned counsel appearing for the respondent-husband however has submitted that respondent-husband is only a Software Engineer and looking at the present market scenario of the Software Industry, this Court may grant some alimony to the appellant-wife. It is further submitted that the appellant-wife is better placed in the - 4 - HC-KAR NC: 2026:KHC:29281-DB MFA No. 833 of 2023 employment than the respondent-husband and she is drawing bigger salary and holding higher position. However, he has left to the discretion of the Court to fix the quantum of alimony. 6. We have considered the submissions of learned counsel for both parties. Both parties are well qualified and are gainfully employed. Considering the above said fact, we fix the alimony at Rs.12,00,000/- (Rupees Twelve Lakhs only) to be paid by the respondent-husband to the appellant-wife within a period of one month from today i.e., on or before 15.08.2026. This alimony of Rs.12,00,000/- (Rupees Twelve Lakhs only) would be towards full and final settlement of rights and claims of the appellant-wife against the respondent-husband.
