JUSTICE ANU SIVARAMAN) We have heard the learned counsel appearing for the complainants in both Contempt of Court Cases. 2. CCC No.1174/2022 alleges that, in violation of the directions issued by this Court in Annexure-A, the accused have put up constructions and changed the nature and character of item No.18 of Suit Schedule 'B' Property. Statement of - 4 - HC-KAR NC: 2026:KHC:28456-DB CCC No. 1174 of 2022 C/W CCC No. 118 of 2024 objections has been filed by the accused in the said Contempt of Court Case alleging that no change in nature of the property has been carried out and what has been done is only a temporary construction in item No.18 of Suit Schedule 'B' Property. 3. In CCC No.118/2024, the allegation is that constructions have been made by the complainants in the earlier Contempt of Court Case as well in item No.1 of Suit Schedule 'C' Property. 4. Having considered the contentions advanced, we notice that this Court has specifically injuncted maintenance of status-quo with regard to title as well as nature and character of the remaining Suit Schedule Properties pending disposal of the suit. The parties now contend violation of the said order. There are clear denials in the affidavit filed by the respondents. Since the question whether the order has been violated or not is clearly a disputed question of fact and since allegations are made by both the parties against each other, we are of the opinion that this is not a fit case where the contempt jurisdiction of this Court is liable to be invoked. We therefore - 5 - HC-KAR NC: 2026:KHC:28456-DB CCC No. 1174 of 2022 C/W CCC No. 118 of 2024 dispose of this Contempt of Court Case directing the parties to comply with the order of status-quo issued by this Court. In case any alteration of such order is necessary, it is for the parties to approach the Court and seek permission for the said purpose. Notice issued to the accused/respondents in both the Contempt of Court Cases shall stand discharged. Pending application(s), if any also stand disposed of.
