It is prayer of the petitioner that respondent No.2 i.e. Circle Officer, Patamda should take a decision on the proceeding which has been initiated by Notice No. 756 dated 06.09.2025 (Annexure-2) 3. After going through Annexure-2, I find that Circle Officer, Patamda has issued a notice to the petitioner showing him a first party and Gopal Kaibart as second party to appear along with all the title documents of the disputed land of Mouza Bidra, Thana No. 89, Khata No. 468, Plot No. 273 area 27 decimals for hearing. 4. This Court fails to understand that under what jurisdiction the Circle Officer, Patamda has issued the aforesaid notice. The notice neither specify the provision of any statute nor discloses the jurisdiction which he has invoked. 5. Further, from the notice, I am of the opinion that dispute is between the private persons over some land which the Circle Officer is trying to resolve. 6. A title dispute or any land dispute. Between private individuals, cannot be decided by the Circle Officer. He has got no jurisdiction or authority to entertain the same. If there is any title dispute between two private individuals, they should approach the appropriate Civil Court for claiming relief. The Circle Officer has got no jurisdiction to adjudicate the dispute. Further, the notice has been issued without any jurisdiction thus same will not be given effect to. 7. With the aforesaid observation, this writ petition stands disposed of. Pending, interlocutory application, if any stands disposed of.
