1. By the present revisional application, the petitioner seeks expeditious disposal of an application for amendment of plaint filed by the petitioner in Title Suit No. 297 of 2016 pending before the 3rd Court of the Learned Civil Judge, Senior Division at Howrah as also the expeditious disposal of the suit itself.
2. In view of the nature of the order proposed to be passed, no direction for prior service of the copy of the application is being made upon the opposite parties. However, the petitioner shall remain obliged to serve copies of the application along with copies of this order upon the opposite parties within a week from date.
3. It is noticed that earlier too, this Court had by an order dated March 19, 2024 passed in C.O. No. 2834 of 2022 requested the learned Trial Court to dispose of a pending interlocutory application within one month from the next
2 date fixed and upon disposal of the application to dispose of the suit preferably within a period of eight months.
4. The learned advocate appearing for the petitioner submits that although the said application has been disposed of, another application for amendment under order 6 Rule 17 of the Code of Civil Procedure, 1908 filed by the petitioner on September 6, 2024 still remains pending despite objection thereto having been filed on February 11, 2026.
5. The learned trial court is requested to dispose of the application for amendment as expeditiously as possible preferably within a month from the next date fixed. The learned Trial Court is also requested to proceed with the suit as expeditiously as possible.
6. Accordingly, the revisional application being C.O. 729 of 2026 is disposed of.
