JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 3 are common in both the petitions are before this Court calling in question registration of a crime in Crime No.253/2022, and during the pendency of the petition, the police conduct investigation and have filed a charge sheet in C.C.No.238/2023, for the offences under Sections 323, 324, 448, 504, 506 r/w. 34 of the IPC, now pending before the Principal Civil Judge and JMFC, Chintamani and a crime in Crime No.162/2023, pending before the 6th - 5 - HC-KAR NC: 2026:KHC:27701 CRL.P No. 8626 of 2023 C/W CRL.P No. 7714 of 2024 Additional Chief Metropolitan Magistrate, Bengaluru, for the offences under Sections 498a, 504, 506 and 34 of the IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioners and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed a joint affidavit before this Court to that effect. 3. The joint affidavit filed in Crl.P.No.8626/2023, reads as follows: “We, 1) SRL K S PRAMOD RAJAN, S/o Sekar G K. Aged about 34 years, 2) SRI G K SEKAR, S/O M G K Velu, Aged about 63 years, 3) SMT. ELIZABETH SEKAR @ LAKSHMI, W/o GK Sekar, Aged about 53 years, R/at No:238, "Keshavelu Nagamma Nilayam", 1st Cross, Behind Kote Kodandarama Temple Street, Near Sarvodaya School, KR Puram, Bangalore- 560036. And Respondent No.2 namely 4) SRI. M. RAGHU, S/o Munivenkatappa, Aged about 36 years, R/at: Anjani Layout, Chintamani Town, Chickballapura District. Postal Pin Code- 563125, do here solemnly affirms as follows:- 1. We state that are we the petitioners and respondent No.2/complainant in the above case and we are well conversant with the facts and circumstances of the case. Hence we are swearing to this affidavit. 2. I, the respondent No.2/complainant submit that I lodged a complaint against the petitioners before the respondent No.1 police station and same was registered in Crime. No.253/2022 - 6 - HC-KAR NC: 2026:KHC:27701 CRL.P No. 8626 of 2023 C/W CRL.P No. 7714 of 2024 for offences punishable under sections U/s 323, 324, 448, 504, 506 r/w 34 of IPC against the petitioners subsequently after investigation, the respondent No.1 police have submitted their charge sheet for the offence punishable under sections U/s 323, 324, 448, 504, 506 r/w 34 of IPC against the petitioners in CC No. 2398/2023 and pending on the file of Hon'ble Principal Civil Judge and JMFC at Chintamani. 3. We the petitioners and respondent No.2/complainant submits that due to the advice of elders and well-wishers of both the sides now we compromised the matter between us and we have decided to put an end to the litigation and we don't want to continue the said case. 4. I, the petitioner No: 1 filed the divorce petition bearing M. C. No: 4541/2023 before Vth Additional Family Court at Bangalore against respondent No:2 sister by name Smt. M. Ashwini and it was settled before mediation on 28-04-2026. Hence the respondent No:2/complainant is not interested in prosecuting/proceeding the above criminal case filed by me, leading the case further will not yield any result and it leads to wastage of valuable time of the Hon'ble court and accrues financial loss to the government exchequer. 5. We the Petitioners and respondent No.2 request this Hon'ble court be pleased to quash the entire proceedings against the petitioners in Cr. No:253/2022, for offences punishable under sections U/s 323, 324, 448, 504, 506 r/w 34 of IPC, subsequently after investigation, the respondent No,1 police have submitted their charge sheet for the offence punishable under sections U/s 323, 324, 448, 504, 506 r/w 34 of IPC against the petitioners in CC No. 2398/2023 and pending on the file of Hon'ble Principal Civil Judge and JMFC at Chintamani. I, the petitioner No: 1 filed the divorce petition bearing M. C. No: 4541/2023 before Vth Additional Family Court at Bangalore against respondent No:2 and it was settled before mediation on 28-04-2026 and I, the respondent No:2 agreed to co-operate with the petitioners to closure of the said Criminal case. 5. I, the respondent No.2 / complainant further submits that in view of settlement arrived in MC No.4541/2025 before Vth Additional Family Court at Bangalore, I the respondent No.2 is - 8 - HC-KAR NC: 2026:KHC:27701 CRL.P No. 8626 of 2023 C/W CRL.P No. 7714 of 2024 not interested in prosecuting/proceeding the above criminal case filed by me, leading the case further will not yield any result and it leads to wastage of valuable time of the Hon’ble court and accrues financial loss to the government exchequer. 6. We the Petitioners and respondent No.2 agreed that before mediation at the time of settlement in MC No.4541/2025 before Vth Additional Family Court at Bangalore, “the Respondent No.2 has no objection for quashing of Cr.No.162/2023 and further she will co-operate to quash the above said crime No.162/2023”. Hence we request this Hon'ble court be pleased to quash the entire proceedings against the petitioners in Cr. No:162/2023 of respondent No.1 for the offences punishable under sections 498(A), 504, 506, 34 of IPC and 3 & 4 of D P Act and pending on the file of Hon'ble 6th Addl. Chief Metropolitan Magistrate, Bengaluru City. Hence, we most respectfully pray that this Hon'ble court may be pleased to pass necessary orders as this Hon'ble court deemed fit in the circumstance of the case, in the interest of Justice.” In the light of the afore-quoted joint affidavits of the parties of both the petitions, I deem it appropriate to terminate the proceedings against the petitioners, as it is a matrimonial dispute and the allegations are not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petitions are disposed. (b) The proceedings in C.C.No.238/2023 (arising out of Crime No.253/2022), pending before the Principal Civil Judge and JMFC, Chintamani, impugned in - 9 - HC-KAR NC: 2026:KHC:27701 CRL.P No. 8626 of 2023 C/W CRL.P No. 7714 of 2024 Crl.P.No.8626/2023 and the Crime No.162/2023, pending before the 6th Additional Chief Metropolitan Magistrate, Bengaluru, impugned in Crl.P.No.7714/2024, qua the petitioners, stand quashed.
