1. This matter is taken up through hybrid arrangement.
2. By filing the present CRLMC, the Petitioner has prayed for issuance of a direction to the learned trial Court, i.e., the learned Addl. Sessions Judge, Dhenkanal, to close the evidence and pronounce judgment within a stipulated time in C.T. (Sessions) Case No.102 of 2021, arising out of Balimi P.S. Case No.90 of 2021, which is presently pending before the said Court.
3. Heard learned counsel for the parties. 348 of the Bharatiya Nagarik Suraksha Sanhita, 2023, recalling P.W.9 and P.W.24 for their further examination. The power to summon or recall a witness is intended to enable the Court to arrive at a just decision and is to be exercised whenever the evidence of such witness appears essential for a fair and complete adjudication of the case. Once the learned trial Court has exercised its judicial discretion and found the examination of the said witnesses necessary for the just decision of the case, this Court finds no illegality, perversity, or jurisdictional error warranting interference in exercise of its inherent jurisdiction. The
order impugned does not suffer from any infirmity so as to call for interference by this Court.
4. Accordingly, the present CRLMC, being devoid of merit, stands dismissed.
5. However, considering that the sessions case is of the year 2021 and keeping in view the mandate of a fair and speedy trial, the learned Addl. Sessions Judge, Dhenkanal, is requested to make all endeavour to ensure expeditious disposal of C.T. (Sessions) Case No.102 of 2021 without granting unnecessary adjournments to either of the parties and to conclude the trial at an early date.
