ORDER The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the second respondent to consider the petitioner’s representation dated 16.09.2025 and conduct a fair inquiry in respect of Patta No. 138, and issue a new patta for the property in Survey Nos. 203/2 and 206/7A at Sevalpatti Village, within a time frame fixed by this Court.
2. The petitioner claims title over the property through her father-in-law, namely, Santhiyagu. The patta stands in the name of the petitioner’s father-in-law in Patta No. 138. After the demise of her father-in-law on 23.08.2004, the property revolves around the petitioner's husband and his sisters, namely, Arokia Mary and Christopher Mary. Thereafter, the petitioner’s husband, namely, Anthony Peter, also died on 17.10.2023. After his death, the petitioner and her children, namely John Neville, Jhansi Rani and Sharal Jennife, are the legal heirs, and they are now in joint possession and enjoyment of the property. 2/5 https://www.mhc.tn.gov.in/judis

3. The contention of the petitioner is that respondents 5 and 6 are in no way entitled to the property. But, their names were entered as joint pattadars. Hence, the petitioner seeks issuance of a separate patta by deleting the names of respondents 5 and 6.
4. The third respondent / Tahsildar is directed to issue notice to the petitioner, as well as to the other two sisters, namely Arokia Mary and Christopher Mary, and also to respondents 5 and 6, and thereafter conduct an enquiry by affording an opportunity of personal hearing. All parties are entitled to produce relevant records. The third respondent / Tahsildar shall pass appropriate orders in accordance with law. The said exercise shall be completed within a period of five months from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
