This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 669/2024 registered at Police Station-Tikrapara, District-Raipur (C.G.) for the offence punishable under Section 331(4), 305-A, 111(4), (7) of the Bhartiya Nyay Sanhita, 2023. 2. Case of the prosecution, in brief, is that 29.08.2024 complainant Praveen Kumar Sika, lodged the Complainant to the Police Station Tikrapara, District Raipur (C.G.), with the averment that on VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.06.23 14:45:07 +0530 2 27.08.2024 he went to Raigarha Orrisa with family and came on 28.08.2024 his neighbor Tomesh Dewangan informed that the Gate of his house is open and he came back and saw that the door was open and silver statue amounting Rs. 25,000/- and cash of Rs. 3,000/- were stolen by some unknown person so on the of said report crime was registered against the unknown persons, during investigation, the present applicant was taken into custody in connection with Crime No. 32/2025 registered at Police Station New Rajendra Nagar, his memorandum statement was recorded and, after production of warrant, arrested in the present crime and charge- sheet is filed. 3. Learned counsel for the applicant submits that the first bail application was rejected by this Court on merits vide order dated 07.08.2025 passed in MCRC No.5446 of 2025, therefore this second bail application is filed on the ground that out of 10 witnesses, the statement of only two witnesses have been recorded, further charge- sheet has already been filed in the present case, the applicant is in jail since 07.04.2025 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. 4. On the other hand, learned State counsel opposes the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that from the memorandum statements of the applicant and co-accused- Ritik Verma that the applicant alongwith co-accused person is stated to have committed robbery in the house of the complainant and had also committed similarly situated offence of loot and robbery at different places 3 between the period May, 2024 to December, 2024 and have sold the looted ornaments to Ashok Soni, owner of Mahadev Jewellers and said fact has also been admitted by co-accused- Ashok Soni in his memorandum statement that the applicant and co-accused- Ritik Verma are main accused in the instant crime and they have sold looted ornaments to him and, even otherwise, this is the second bail application of the applicant and first bail application of the applicant was rejected on merits by this Court vide order dated 07.08.2025 in MCRC No. 5446 of 2025 and this second bail application is being filed on the ground that out of 10 witnesses, the statement of only two witnesses have been recorded. As such, there appears to be no new good ground to grant bail to the applicant that too when as per Part-D of the instant bail application, 04 other crimes of like nature are already registered and pending against the applicant and, therefore, this Court is of the opinion that it is not a fit case to grant second bail to the applicant. 7. Accordingly, the second bail application of the applicant- Mayank Soni, involved in Crime No.669/2024 registered at Police Station- Tikrapara, District-Raipur (C.G.) for the offence punishable under Section 331(4), 305-A, 111(4), (7) of the Bhartiya Nyay Sanhita, 2023 is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
