According to the State, it transpired from the investigations that the child was sold by the petitioner to a third person. Police registered a case with regard thereto being Sankrail Police Station Case No. 282/26 dated April 25, 2026 under Section 81 of the Juvenile Justice (Care and Protection of Children) Act, 2015. Presently, child is in the safe custody of the Child Welfare Committee and is lodged at SMM Home in Liluah. The petitioner is at liberty to approach the relevant Child Welfare Committee for the custody of 2 the child. If such approach is made, Child Welfare Committee will consider and decide such application, in accordance with law. No further order need be passed in the present writ petition. The Child Welfare Committee will not put up the child for adoption for a period of 10 weeks from date or till disposal of the application for custody whichever is later. If no application for custody is made by the petitioner within 10 weeks from date, Child Welfare Committee will proceed in accordance with law, in the best interest of the child.
