No.121 of 2017, the sole accused preferred the present Criminal Appeal under Section 374(2) of the Code of Criminal Procedure, 1973. 2. Today, when the matter is taken up, the learned Additional Public Prosecutor submits that during the pendency of the present appeal and while undergoing imprisonment, the appellant died. In support of the said submission, the learned Additional Public Prosecutor has placed on record the post-mortem certificate pertaining to the appellant. 3. In view of above submission made by the learned Additional Public Prosecutor, the Criminal Appeal is hereby dismissed as abated.
