Hon'ble Shri Justice Sanjay Kumar Jaiswal Order On Board 22/06/2026
1. The applicants have preferred this 1st bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as they are arrested in connection with crime No. 120/2025, SHUBHAM SINGH RAGHUVANSHI Digitally signed by SHUBHAM SINGH RAGHUVANSHI Date: 2026.06.23 11:15:00 +0530
2 registered at Police Station – Baikunthpur, District- Koriya (C.G.) for offence punishable under Sections 103(1), 238(A), 61(2)(A) of BNS. 2. In this case there are total 6 accused persons. The prosecution case, in brief, is that a missing person report was registered on 26.03.2025 on the basis of information given by one Shanta Kurre regarding disappearance of deceased Ashok Kumar. On 29.03.2025, a Dehati Merg Intimation and Dehati Nalsi were registered regarding murder of Ashok Kumar. During investigation, it was found that deceased used to harass his wife Shanta and daughter Sarita physically and mentally, due to which, they were likely to leave the house. Therefore, the present applicant Tausif Khan and his mother Sahnaaz Begum conspired with deceased's wife Shanta Kurre and others to eliminate Ashok Kumar for a ransom of Rs.50,000/-. In execution of conspiracy of murder, on 19.03.2025 at around 11.00 p.m., the present applicant Tausif Khan together with co-accused Amanul alias Baba Khan, deceased's daughter Sarita and deceased's wife Shanta together committed murder of Ashok Kumar. Based on above, offence has been registered against the applicants and they were arrested on
29.03.2025. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the crime in question solely on the basis of circumstantial evidence. No weapon has been seized from the applicants. The dead body of deceased Ashok has also not been found at the house of the applicants.
In similar facts and circumstances, co-accused Sahnaaz Begam and Arbaaz Ansari have already been granted bail by this Court. The applicants are in jail since
29.03.2025. Out of 34 prosecution witnesses, only 4 have been examined till date and the trial is likely to take time to conclude. Therefore, it is prayed that the applicants may be enlarged on bail. 4. Per contra, learned counsel appearing on behalf of the State opposes the bail application and submits that applicant Sarita is the daughter and applicant Shanta is the wife of the deceased. Under a criminal conspiracy, the applicants committed the murder of the deceased. They also used to administer some toxic substance in the food of the deceased. There was active participation of the applicants in the crime
3 in question. She further submits that the bail application of another co- accused, Tausif Khan, has already been rejected by this Court and the case of the applicants is not different from that of co-accused Tausif. Therefore, considering the nature and gravity of the offence, the applicants may not be released on bail. 5. I have heard learned Counsel appearing for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case and evidence collected by the prosecution against the applicants, without commenting on merits of the case, I am not inclined to release the applicants on bail. 7. Accordingly, the bail application is rejected. 8. However, considering the detention period of the applicants, the Trial Court is directed to expedite the trial and ensure that the trial is concluded as early as possible, preferably within a period of five months from the date of receipt of a copy of this order. 9. A copy of this order be sent to the Trial Court concerned for information and necessary compliance. Sd/- (Sanjay Kumar Jaiswal) Judge Shubham
