The petitioners have filed this petition seeking the following relief(s):- “10.1 This Hon’ble Court may kindly be pleased issue an appropriate writ and direct the respondents for promoting the petitioners to the post of Head Master (Middle School) while considering their paper seniority w.e.f. 26.11.2013 in compliance of the Notification dated 31.12.2021 published in Official Gazette (Extra-ordinary), in the interest of justice. 10.2 This Hon’ble Court may kindly be pleased issue an appropriate writ and direct the respondent no. 04 to decide the representation of the petitioners, in the interest of justice. 10.3 This Hon’ble Court may further be pleased to pass an appropriate order or issue writ as deemed fit under the facts and circumstances of the case.” 2. Mr. R.S. Patel, learned counsel appearing for the petitioner would argue that the petitioners are working on the post of Head Masters, Primary School under the respondents and they were appointed in the year 2010. He would submit that the petitioners are post-graduate Head Masters and were entitled for promotion to the post of Lecturer after completion of 03 years of service, but their claims have not been considered. He would submit that the petitioners made repeated representations before the respondent authorities, but till date no action has been taken. 3. On the other hand, Mr. Abhishek Singh, learned Penal Lawyer appearing for the State/respondents would submit that the services of the petitioners have already been absorbed with the School Education Department pursuant to policy decision dated 30.06.2018. He would submit that the petitioners have claimed promotion from back date when they were working under Panchayat Department, therefore, this petition is not maintainable. 4. At this stage, Mr. R.S. Patel would submit the in para- 7 of reply, State has categorically stated that the benefit of promotion after absorption of 3 services of the petitioners in School Education Department can be considered. He would submit that the petitioners may be permitted to make a fresh representation(s) before respondent No.1 and in turn, the authority concerned may be directed to decide it expeditiously strictly in accordance with law. 5. Heard learned counsel for the parties and perused the documents. 6. In Para-7 of the reply reads as under:- “7. So far as the claim of the petitioners for granting promotion/paper seniority to the petitioners to the post of Head Master (Middle School) with effect from 26/11/2013 i.e. after completion of 3 years teaching experience. In this regard it is respectfully submitted that the said relief can only be extended by the concerned Janpad/Zila Panchayat and not from the answering respondents as the petitioner born in the cadre of School Education Department only on 1st July, 2018 i.e. the date of absorption and the benefit as has been claimed prior to absorption is not maintainable on the part of the answering respondents and thus the instant petition as against the answering respondents/State deserves to be dismissed.” 7. Taking into consideration the contents made in Para- 7 of the reply and the prayer made by Mr. R.S. Patel, this petition, at this juncture, is disposed of reserving liberty in favour of the petitioners to make detailed representation before respondent No.1 and the said authority is directed to decide it expeditiously in objective manner within a period of 120 days keeping in mind the observation made by the State in Para- 7 of reply to the writ petition. 8.
