Learned counsel appearing on behalf of the petitioner has filed this petition seeking quashment of Order No. 76-SHS of 2026 dated 11.07.2026 to the extent it rescinds Order No. 218 of 2025 dated 03.12.2025 pertaining to the petitioner and further seeking a direction commanding respondent No. 2 to permit the petitioner to continue as Medical Officer at Community Health Centre, Sohanjana, District Jammu.

A specific query was put to the learned counsel for the petitioner as to whether the petitioner had approached respondent No. 2 for redressal of her grievance on the ground that the order impugned dated 11.07.2026 is in contravention of the Human Resource Guidelines framed by the National Health Mission (NHM) for posting and transfer of employees.
Learned counsel for the petitioner very fairly submits that the petitioner has not submitted any representation before respondent No. 2. He further prayed that the instant petition itself be treated as a representation and that Sr. No. 148

respondent No. 2 be directed to consider and decide the same in accordance with law and the rules governing the field.
3. Issue notice, which is waived by Ms. Saliqa Sheikh, Advocate on behalf of the respondents.
4. Mr. Raman Sharma, learned AAG appearing on behalf of the respondents submits that he has no objection to the prayer made by the learned counsel for the petitioner.

Accordingly, the instant writ petition, along with the connected application(s), is disposed of by directing respondent No. 2 to treat the instant writ petition as a representation preferred by the petitioner and to consider and decide the same, in accordance with law and the rules governing the field, within a period of three weeks from the date of this
order.
6. The petitioner shall furnish a certified copy of this order along with a copy of the writ petition and its annexures to respondent No. 2. Till such time the representation is decided by respondent No. 2 within the aforesaid period of three weeks, the status of the petitioner, as on today, shall remain undisturbed.
7. In the aforesaid backdrop, the instant writ petition is disposed of in the manner as indicated above along with all connected application(s).
