In spite of service of notice respondent nos. 4 and 5 are not represented. 3. It is submitted on behalf of the petitioner that the private respondents are disturbing peaceful possession of the petitioner in respect of land which prompted the petitioner to bring it to the notice of the concerned police authorities for initiating appropriate proceeding. Prayer is made in the writ petition to direct the concerned police authorities to take steps which would protect the interest of the petitioner over the land in question and restrain the private respondents from encroaching the said land. 4. Learned advocate representing the State respondents has filed a communicated dated 18.03.2026 of Officer-in-Charge, Sagar Police Station, Sundarban Police District and the same is taken on record. 2 5. It is disclosed in the said communication dated 18.03.2026 that certain preventive steps have been taken by the police authorities against the private respondents and a proceeding being Sagar PS NCR No. 662 of 2025 dated 28.11.2025 was initiated. In the same breath it is also stated in the communication that dispute is concerning right of the respective parties over the land in question. 6. Having considered the submissions made on behalf of the parties and taking note of the contents of the said communication dated 18.03.2026, it is found that both the petitioner and private respondents are claiming right over the land in question which needs to be determined by the civil court. Leave is granted to the petitioner to approach the civil court in pursuit of remedies. 7. However, concerned police authorities are directed to maintain peace and tranquility at the locale and to keep vigil. 8. Accordingly, the writ petition stands disposed of. 9. Urgent certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. 10.
