This CRLMP has been filed for issue of a writ of mandamus directing the Opposite Party No.4 to execute the conditional NBW issued vide order dated 04.09.2025 by the learned Judge, Family Court, Jajpur. 2. Mr. R. R. Das Nayak, learned counsel for the Petitioner submits that conditional NBW has been issued on 20.09.2025 to the IIC, Brahmabarada Police Station and not on
04.09.2025. He further submits that on 04.09.2025, NBW had been issued to the IIC, Jajpur Sadar Police Station, but thereafter since the warrant was returned from the IIC, Jajpur
Sadar Police Station stating that the warantee under the jurisdiction of the Brahmabarada Police Station, on 20.09.2025, fresh warrant was issued against the Opposite Party to the IIC, Brahmabarada Police Station. 3. It has been stated by the IIC, Brahmabarada Police Station in his instructions dated 29.06.2026 that he had received the warrant in the month of September, 2025 and has conducted raids to arrest the warrantee, but since he always remains absent from his house and absconds from the locality, the warrant could not be executed. It has further been stated that the whereabouts of the warrantee are not known and as none of the villagers or his relatives gave his mobile number, the warrant could not be executed. 4. Mr. R. R. Das Nayak, learned counsel for the Petitioner submits that he shall instruct the Petitioner to supply information regarding the mobile number of the warrantee as well as his present whereabouts, if it is known to her and thereby assist the police for execution of the distress warrant and conditional NBW, which has been issued on 20.09.2025 to the IIC, Brahmabarada Police Station. In view of the instructions of the IIC, Brahmabarada Police Station and the submissions of the learned counsel for the Petitioner, the CRLMP is disposed of directing the IIC, Brahmabarada Police Station to take sincere steps for execution of the conditional NBW and distress warrant which has been issued since more than nine months ago, within a period of 4 months from the today. 6. Mr. R. R. Das Nayak, learned counsel for the Petitioner submits that he shall instruct the petitioner to supply the relevant information to the IIC, Brahmabarada Police Station within a period of two weeks.
