2. The prosecution story, in brief, is that on the basis of a written report lodged by complainant Anand Chand Shrivas, FIR bearing Crime No.263/2026 registered at Police Station Civil Lines, District Bilaspur for offences punishable under Sections 296, 115(2), 351(3), 109 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. It is alleged that on 20.02.2026 at about 7:30 PM near Lakhiram Auditorium, Bilaspur, the present applicant along with co-accused persons abused and assaulted Aditya Pratap Shrivas and his companions, causing injuries to them by means of a sharp-edged weapon and fists and kicks. During investigation, statements of witnesses were recorded, medical documents of the injured persons were collected and thereafter the applicant was arrested on 02.06.2026 and remanded to judicial custody, where he continues to remain confined. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated owing to previous rivalry between two groups of students and that the prosecution has suppressed the true genesis of the incident. It is contended that immediately after the occurrence, the applicant’s father lodged a written complaint before the concerned police authorities and also approached the Superintendent of Police seeking a fair investigation. Learned counsel further submits that CCTV footage collected from the vicinity of the place of occurrence prima facie contradicts the prosecution version and indicates participation of the complainant side in the incident.
It is argued that the applicant is a 20-year-old
3 law student pursuing B.A. LL.B., whose continued incarceration is adversely affecting his education and future career. It is also submitted that a co-accused has already been granted relief by the Hon’ble Supreme Court and, therefore, the applicant is entitled to the benefit of parity. Learned counsel submits that the applicant has no criminal antecedent involving any serious offence, is languishing is in jail since 02.06.2026 and the conclusion of the trial is likely to take some time, hence he prays for grant of bail to the applicant. 4. Learned counsel appearing for the State/non-applicant opposes the bail application of the applicant and also the submission advanced by learned counsel for the applicant but could not dispute the fact that applicant is a young boy aged about 20 years and has no criminal antecedent involving any serious offence. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the the existence of CCTV footage relied upon by the defence, the fact that the exact manner of occurrence and role attributed to the applicant are matters to be examined during trial, as also the fact that the applicant is a young B.A. LL.B. student whose continued incarceration may adversely affect his academic career and further the has no previous criminal antecedents registered
4 against him for any serious offence, the applicant is in jail since 02.06.2026 and conclusion of the trial is likely to take some time, I am inclined to allow this application. 7.
