The petitioner is apprehending his arrest in connection with Complaint Case No.302/2024, registered for the offence under Section 376 of the I.P.C., pending in the Court of the learned A.C.J.M., Deoghar. 3. Mr. P.P.N. Roy, learned senior counsel appearing for the petitioner along with Mr. Kamdeo Pandey submits that the matter is arising out of complaint case and now cognizance has been taken. He next submits that although there is no need of custodial interrogation in the complaint case, however, the learned Additional Sessions Judge has been pleased to reject the anticipatory bail petition filed by the petitioner and in view of that, the petitioner may kindly be enlarged on anticipatory bail. 4. Learned counsel appearing for the State submits that the matter is arising out of complaint case. 5. In view of the above and considering the judgment passed by the Hon’ble Supreme Court in the case of Om Prakash Chhawnika @ Om Prakash Chabnika @ Om Prakash Chawnika v. State of Jharkhand and another, reported in 2023 SCC OnLine SC 676, the petitioner is ( 2026:JHHC:25289 ) -2- A.B.A. No. 4747 of 2026 directed to surrender before the learned Court within three weeks from today and the learned Court shall release the petitioner on such terms and conditions as the learned Court may deem fit and proper. 6.
