This anticipatory bail application has been filed under Section 482 of BNSS, 2023 on behalf of accused-petitioner in connection with FIR No.204/2023 registered at Police Station Ranpur, District Kota City for the offences under Sections 8/15 and 8/29 of NDPS Act. 2. Learned counsel appearing for the petitioner submits that the accused-petitioner has been made an accused on the basis of statement of the co-accused, namely, Rahul and Suresh from whose possession the alleged contraband i.e. 15 Kg Doda-Chura is said to have been recovered. He further submits that the accused- petitioner is ready to cooperate with the investigation and no purpose would be served in sending him custody. 3. Learned Public Prosecutor vehemently opposed the bail application and submits that the co-accused, namely, Rahul and Suresh in their statements have stated that they have purchased [2026:RJ-JP:15460] (2 of 2) [CRLMB-1964/2026] the alleged contraband from the accused-petitioner whose cell phone number is 9589604017. He also submits that during investigation, it has been found that the aforesaid cell phone number was being used by the accused-petitioner. 4. Taking into consideration overall facts and circumstances of the case and so also the facts that the statement of the co- accused recorded under Section 67 of the NDPS Act, cannot be discarded in an ordinary manner wherein, they have stated that they have purchased the alleged contraband recovered from their possession and the accused-petitioner is required for detailed investigation, hence, this Court is not inclined to extend the benefit of anticipatory bail to the accused-petitioner. 5.
