1. The present writ petition arises out of an Original Application filed before the West Bengal Administrative Tribunal (in short ‘Tribunal’) bearing O.A. No.22 of 2026. The grievance of the writ petitioner in substance was non- acceptance of his application for resignation.
2. There is a development subsequent to filing of the writ petition, being issuance of an order dated 22.05.2026. The order is issued by the Special Secretary to the Government of West Bengal, Health & Family Welfare Department, communicating acceptance of the petitioner’s prayer for resignation from the post of Associate Professor, Department of General medicine at Calcutta National Medical College & Hospital, Kolkata w.e.f. 03.07.2025. The order directs the petitioner to refund the salary of two months to facilitate issuance of the release order.

The learned advocate for the writ petitioner has also handed over a written instructions from the writ petitioner dated 03.06.2026 in the light of issuance of the order dated 22.05.2026 by the Special Secretary to the Government of West Bengal. The instruction specifically requests the learned advocate to withdraw the present writ petition.
4. Considering the order dated 22.05.2026 and the written instruction dated 03.06.2026, we permit withdrawal of the writ petition.
5. The writ petition is, accordingly, dismissed.
6. The parties are ad idem that having regard to acceptance of the writ petitioner’s resignation, nothing survives in the Original Application being O.A. No.22 of 2026, pending before the West Bengal Administrative Tribunal. The same is disposed of accordingly.
7. The written instruction of the writ petitioner and the order of the Special Secretary to the Government of West Bengal, Health & Family Welfare Department are kept on record.
