Accused no.2 in S.C.No.1931/2023 pending before the Court of LXI Addl. City Civil & Sessions Judge, Bengaluru City, arising out of Crime No.351/2023 registered by Sampigehalli Police Station, Bengaluru City, for the offences punishable under Sections 341, 109, 307, 324, 120B read with 34 IPC and Section 25(1B)(b) of the Arms Act, is before this Court in this petition filed under Section 439 Cr.PC seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.351/2023 was registered by Sampigehalli Police Station, Bengaluru City, initially for the offences punishable under Sections 109, 307 read with 34 IPC against one Smt. Sadiya and three unknown persons. During the course of investigation, petitioner was arrested on 14.10.2023 and remanded to judicial custody. Bail application filed by the petitioner before the Trial Court in S.C.No.1931/2023 was rejected on 22.04.2026. Therefore, he is before this Court. 5. Learned Counsel for the petitioner submits that the victim has suffered simple injuries in the incident in question. Accused nos.1, 3 & 4 in the present case have been already granted regular bail by this Court in Crl.P.No.11343/2024, Crl.P.No.654/2024 & Crl.P.No.479/2024, respectively. Accordingly, he prays to allow the petition. 6. Per contra, learned HCGP appearing for the respondent- State who has opposed the petition, prays to dismiss the petition. 7. The allegation in the complaint is that at the instance of accused no.1, three unknown persons have assaulted the first informant. During the course of investigation, the petitioner was arrested on 14.10.2023 and he is in custody from the date of arrest. Investigation in the case is completed and charge sheet has been filed. Undisputedly, the victim has suffered only simple injuries in the present case. Accused nos.1, 3 & 4 in the present case have been already granted regular bail by this Court in Crl.P.No.11343/2024, Crl.P.No.654/2024 & Crl.P.No.479/2024, respectively. Under the circumstances, I am of the opinion that the prayer made by the petitioner is - 4 - HC-KAR NC: 2026:KHC:30460 CRL.P No. 6737 of 2026 required to be answered affirmatively, on the ground of parity. Accordingly, the following order: 8. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.1931/2023 pending before the Court of LXI Addl. City Civil & Sessions Judge, Bengaluru City, arising out of Crime No.351/2023 registered by Sampigehalli Police Station, Bengaluru City, for the offences punishable under Sections 341, 109, 307, 324, 120B read with 34 IPC and Section 25(1B)(b) of the Arms Act, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR NC: 2026:KHC:30460 CRL.P No. 6737 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
