This criminal revision is filed under Section 102 of the Juvenile Justice (Care and Protection of Children) Act, 2015 against the order dated 07.10.2025 passed in Criminal Case No. 218/2025 by the learned Additional Sessions Judge (F.T.C.) and Children Court, Bilaspur, District - Bilaspur, (C.G), whereby the appeal preferred by the present applicant has been dismissed. 2. Case of the prosecution is that the complainant lodged a complaint dated 31.07.2025 regarding an incident that occurred on 30.07.2025 at around 8:30 p.m. The complainant’s friend, Suresh Kumar Sahu, came to the complainant’s hostel room and informed him that while he was returning from his home to the hostel, some boys were standing near the road and PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.01.08 14:19:10 +0530
2 had a dispute with him. At around 9:10 p.m., when Suresh Kumar Sahu left the hostel to return home, the complainant and Siddharth accompanied him to see him off. At that time, the accused Vikas began abusing them and called his friends Kishan and Kalle. Kishan was armed with a stick, Kalle with a hockey stick, and Vikas with a belt. They assaulted the complainant and used abusive language. One of the accused was also carrying a knife and waved it two to three times with the intent to kill the complainant. During this assault, Suresh Kumar Sahu sustained injuries on the right side of his body and suffered a scar on the back of his chest. On the basis of the complainant’s report, Police Station Koni registered FIR No. 344/2025 for the alleged offences under Sections 296, 115(2), 351(3), 324(4), 109, and 191(2) of the BNS, along with Sections 25 and 27 of the Arms Act. Being aggrieved by the order dated 28.05.2025, the applicants/juveniles filed and appeal before the appellate Court, which has been dismissed vide impugned order dated 13.06.2025. 3. Learned counsel for the applicants submits that the applicant is a student.
She also submits that the name of the applicant is neither present in FIR nor in Dehati Nalishi/inquest report. She further submits that the main accused person, namely, Anurag Yadav and co-accused, namely, Sanjay Baghel have already been granted regular bail by this Court vide order dated 10.11.2025 in MCRC No. 8943/2025 and vide order dated 13.11.2025 passed in MCRC No. 9127/2025 and as such the case of the present applicant is similar to that of co-accused person who have granted bail by this Court. Hence, on the ground of parity, he prays for grant of bail to the present applicants. 4. On the other hand, learned State counsel opposes the submission made by learned counsel for the applicant. 5. I have heard learned counsel for the parties and perused the records. 3

From perusal of records, it appears that the applicant is a student and the name of the applicant is neither present in FIR nor in Dehati Nalishi/inquest report, further, the main accused person, namely, Anurag Yadav and co-accused, namely, Sanjay Baghel have already been granted regular bail by this Court vide order dated 10.11.2025 in MCRC No. 8943/2025 and vide order dated 13.11.2025 passed in MCRC No. 9127/2025 and as such the case of the present applicant is similar to that of co-accused person who have granted bail by this Court. Considering the above aspect, I am inclined to allow this criminal revision on the ground of parity, as the case of the present applicant is similar to that of co-accused who has granted bail by this Court. 7. Consequently, criminal revision is allowed. The impugned order dated 07.10.2025 passed by the learned Additional Session Judge (F.T.C.) and Children Court, Bilaspur, District – Bilaspur (C.G.) in Crime No. 218/2025 are set aside. It is directed that on furnishing a surety of Rs.
50,000/-along with a bond of same amount which are to be of their natural guardian/father/mother, to the satisfaction of the concerned Juvenile Justice Board, for this appearance as when directed, the applicant shall be given in custody of their natural guardian/father/mother.
