JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner asserts he is in possession of land measuring two acres in Survey No.109/2 of Halkur Village, Kasaba Hobli, Sira Taluk, Tumakuru District [the Subject Property], and the petitioner has invoked this Court's jurisdiction in the writ petition in W.P. No.24142/2022 calling in question the outcome at the instance of third parties in the proceedings under the Karnataka Scheduled Caste and Scheduled Tribes [Prohibition of Transfer of - 3 - HC-KAR NC: 2026:KHC:27000 WP No. 14944 of 2026 Certain Lands] Act, 1978 [for short ‘the Act’]. This Court, on 13.12.2022 has granted interim order staying the restoration as decided by the authorities under the Act. 2. The petitioner is aggrieved with the Endorsement dated 13.04.2026. The second respondent has issued the impugned Endorsement dated 13.04.2026 to the petitioner informing him that his application for renewal of general license to run a ‘cement bricks factory’ cannot be considered because he has not enclosed RTC with his name for the subject property. Sri J Manjunatha Reddy, the learned counsel for the petitioner, submits that this Court must intervene because the second respondent could not have issued the Endorsement without considering the facts such as: [a] The petitioner continues to occupy the subject property by virtue of the interim - 4 - HC-KAR NC: 2026:KHC:27000 WP No. 14944 of 2026 order granted by this Court in the writ petition in W.P. No. 24142/2022, [b] The subject property is diverted from agricultural to non-agricultural industrial uses in the year 2003, [c] The general license to run a brick factory has been issued in the year 2021. [d] The petitioner has continued to run the brick factory all through these years notwithstanding the pendency of the petition. 3. Sri Bopanna Belliappa, a learned Additional Government Advocate, who is called upon to accept notice for the first respondent, is heard to decide whether this Court must intervene in the present proceedings or dispose of the petition with liberty to the petitioner to move an application in the pending writ petition in W.P. This Court is of the considered view that lest there be multiple petitions on the core cause of action, the petition must be disposed of with liberty to the petitioner to move an application in the pending petition as every aspect including whether the second respondent could issue such an Endorsement can be considered in such a petition where not only the second respondent would be a party but also the legal representatives of the original grantee.
