Also heard Mr. Lukesh Kumar Mishra, learned counsel appearing for respondent No.2, as well as Mr. Sourabh Sahu, learned State counsel for the respondent/State. Today, the matter has been listed by way of PUD submitted by the Office dated 19.06.2026. It transpires from the record that notices were issued to respondent No.2 on 02.05.2026 in CRMP No.2756 of 2025 directing her appearance before this Court on 19.06.2026. However, prior to the date fixed for her appearance, the case was inadvertently listed on 16.06.2026 instead of 19.06.2026 as directed by this Court, and an order came to be passed on 16.06.2026 disposing of the petition ex parte. While passing the said order, this Court recorded that the mediation proceedings between the parties had failed and that the petitioner had deposited a sum of Rs.1,00,000/- during the mediation proceedings pursuant to the directions of 3 / 4 this Court, which amount had been received by respondent No.2. Thus, the order dated 16.06.2026 came to be passed before the date fixed for the appearance of respondent No.2. Upon examination of the record by the Registrar (Judicial), it was noticed that the matter had been listed on 16.06.2026 by the concerned Dealing Assistant and was consequently disposed of. It further transpires from the record that, in view of the inconvenience caused to the Court and the apparent procedural lapse, explanations were called for from the concerned Dealing Assistant and the Section Officer. The explanations submitted by the concerned officials have been considered and are found to be unsatisfactory. Accordingly, the Registrar concerned is directed to proceed against the said officials in accordance with the applicable Rules. In view of the aforesaid circumstances, the order dated 16.06.2026 passed in CRMP No.2756 of 2025 is recalled. Consequently, CRMP No.2756 of 2025 is 4 / 4 Manpreet restored to its original number. Learned counsel appearing for respondent No.2 prays for and is granted two weeks’ time to file reply. One week thereafter is granted to the petitioner for filing rejoinder/reminder.
