This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.132/2026 registered at Police Station Palari, District- Balodabazar- Bhatapara (C.G. for the offence punishable under Sections 64 (2) & 351 (2) of Bhartiya Nyaya Sanhita. Case of the prosecution, in brief, is that the FIR was lodged by the victim alleging inter-alia that on 16-03-2026, she went to answer the call of nature and at that time, the applicant came there and performed the rituals of marriage and asked the victim that she is a wife and prepared the video and established the physical relationship with the victim against her will and wish. It is also alleged that when the marriage of the victim was fixed with another person, one of the person belonging to the same locality, came to the house of victim shown the photograph of victim to the brother of victim and sister in-law of the victim and thereafter the victim reveals about the incident to her family members. On the basis of report lodged by the victim, the police arrested the applicant for the commission of alleged. 3. Learned counsel for the applicant submitted that the victim was a major girl and she was a consenting party. He would submit that charge sheet has been filed, the applicant is in jail since 23/03/2026 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that the statement of the victim recorded under Section 183 of the BNSS reveals that when she had gone to attend the call of nature, the applicant forcibly committed rape upon her after applying vermilion on her forehead and tying a mangalsutra around her neck. Thereafter, he threatened her not to disclose the incident to her family members. It is further submitted that the applicant had taken photographs of the victim and threatened that if she married another person, he would send those photographs to her prospective husband. 3 It is alleged that when the victim's marriage was fixed, the applicant sent the photographs, resulting in the cancellation of her marriage, and continued to threaten her with dire consequences. Therefore, considering the serious nature of the allegations, the applicant is not entitled to grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the nature and gravity of the allegations, the statement of the victim recorded under Section 183 of BNSS, and the specific allegations that the applicant committed rape, took photographs of the victim, and threatened her with dire consequences, this Court is not inclined to grant bail to the applicant. 7. Accordingly, the bail application of applicant Dinesh Manhare involved in Crime No.132/2026 registered at Police Station Palari, District- Balodabazar- Bhatapara (C.G.) for the offence punishable under Sections 64 (2) & 351 (2) of Bhartiya Nyaya Sanhita, is rejected. 8.
