Accused Nos.1 and 2 in Crime No.153/2026 registered by Pulakeshinagar Police Station, Bengaluru City, for the offences punishable under Sections 120B, 406, 463, 417, 420, 465, 464 and 468 of IPC, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.153/2026 was registered by Pulakeshinagar Police Station, Bengaluru City, for the aforesaid offences after a private complaint filed by one Sri. S. Narayana, was referred to the said police station by the Court of jurisdictional Magistrate. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.5027/2026 before the jurisdictional Sessions Court which was rejected on 06.06.2026. Material produced before this Court would go to show that dispute between the parties is purely civil in nature. 5. Learned Senior counsel appearing on behalf of the petitioners referring to the documents produced before this Court has submitted that parties had entered into a Joint Development Agreement on 10.02.2016 and for the purpose of adjudicating the said dispute, parties are already before the Sole Arbitrator in AC No.234/2024. 6. Undisputedly, petitioners do not have any criminal antecedents. Petitioner No.1, is the father of petitioner No.2. They have undertaken to cooperate with the police for the purpose of investigation. The alleged offences are triable by the Court of Magistrate and the maximum punishment for the alleged offences is imprisonment for a period of seven years. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime - 4 - HC-KAR NC: 2026:KHC:30463 CRL.P No. 8036 of 2026 No.153/2026 registered by Pulakeshinagar Police Station, Bengaluru City, for the offences punishable under Sections 120B, 406, 463, 417, 420, 465, 464 and 468 of IPC, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
