1. The petitioner has preferred the present writ petition for correction of the calculation sheet of the pension as the qualifying service of the petitioner has wrongly been taken into
consideration for calculation of pension sheet and the period for which the petitioner has a daily wages employee that was not considered.

Learned counsel for the petitioner submits that the similar issue has been decided by this Court in WPS No.8727/2022 on 18/01/2023. Para 6 of WPS No.8727/2022 held as under:-
“Case of petitioner is that petitioner was employed by respondent Department in the year 1988, since then he continuously worked as daily wage employee and on account of his continuous engagement, he was regularized in service. Prior to regularization, petitioner was being paid from contingency fund. Engagement of petitioner as daily wage employee for continuous long time as also continuous payment of wages to him from contingent fund, is not in dispute, therefore, in view of decisions of Division Bench in WA Nos. 281/2013 & 88/2019, this writ petition is also disposed of directing respondents to consider claim of petitioner in terms of orders passed in aforementioned writ appeals and also to calculate period of service of
3 petitioner taking into account period of service, after five years of service from the date of appointment, rendered by him prior to his regularization for the purpose of grant of retiral dues including pensionary benefits. For the purpose of calculation of period of service, respondents may verify service record of petitioner”
3. On the other hand, learned counsel appearing for the State does not dispute the submission of learned counsel for the petitioner and the decision passed in WPS No.8727/2022.

Having considered the rival submissions made by learned counsel for the parties and having gone through the materials available on record, it is evident that the facts and issue involved in this petition is identical to WPS No.8727/2022, this Court deems it appropriate not to take a view other than what has been taken in the aforesaid writ petition.
5. Accordingly, the present petition is disposed of in terms of the
order dated 18/01/2023 passed in WPS No.8727/2022 with a direction to the respondents to consider the case of the petitioner for calculation of pension as well as the period of qualifying service period of the petitioner within a period of 45 days from the date of production of this order. SD/-
