Heard the parties through their learned advocates. Mr. Amal Kr. Sen, learned A. A. G. appearing for the State respondents in WPA 29087 of 2025 and WPA 29093 of 2025 files a report as indicated in the order dated 02.01.2026 and the same be kept with the records. It is submitted by Mr. Sen that the notification dated 03.10.2016 has already been clarified and modified by a further Gazetted Notification No. 226- WT/TPT/18011/65/2022 on 21.01.2026. The modified portion of the Notification is reproduced below:
“1. The said Notification does not exempt an application from payment of permit fees each district/region in cases where route(s) extend beyond a single district/region” and
2. For the purpose of functioning of the State Transport Authority, West Bengal (STA, WB), each
3 administrative/revenue district be treated as a separate region for the issuance of an inter-region permit.”
Learned counsel for the petitioner submits that already the permit has been granted but not issued by the authority concerned. After careful consideration of the case I find that the authority has already taken the matter into
consideration and has issued the offer letter and provided permission even though the signing is still pending. In view of the above, I direct the respondent nos. 4 to forthwith issue the permit in accordance with law preferably within a period of two weeks from the date of communication of the order upon compliance of all necessary formalities. The writ petitions being WPA 29087 of 2025, WPA 29078 of 2025, WPA 29084 of 2025, WPA 29090 of 2025, WPA 29093 of 2025 and WPA 29097 of 2025 are hereby disposed of accordingly in the light of the Gazetted Notification dated 21.01.2026. Since no affidavit has been called for, the allegations made in the writ petitions are deemed not to be admitted by the respondents.
