JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No. 2/2026 registered by the Lokayuktha Police Station, Mandya, for the offences punishable under Sections 13(1)(a) read with Section 13(2) of the Prevention of Corruption Act, 1988 and Sections 409, 420, 465, 468, 201 read with Section 120(B) of the Indian Penal Code, is before this Court in this petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'BNSS, 2023' for short), seeking anticipatory bail. 2. It is brought to the notice of this Court that petitioner has approached this Court under Section 528 of BNSS, 2023, in Crl.P.No. 4252/2026 with a prayer to quash the entire proceedings in Crime No. 2/2026 registered by the Lokayuktha Police Station, Mandya, for - 3 - HC-KAR NC: 2026:KHC:30609 CRL.P No. 6206 of 2026 the aforesaid offences against him and in the said petition, the Co-ordinate Bench of this Court, vide order dated 21.04.2026 has passed an order directing the investigating agency not to take coercive steps as against the petitioner who is a retired Government servant, aged about 65 years, provided the petitioner co-operates with the investigation. 3. Learned counsel for the respondent on instructions submits that pursuant to the order dated 21.04.2026 passed in Crl.P.No. 4252/2026, petitioner has co-operated with the police for the purpose of investigation and during the pendency of Crl.P.No. 4252/2026, the respondent - Police has no intention to arrest the petitioner. 4. The said submission is placed on record. In view of the aforesaid, since the petitioner has no apprehension of arrest for the present, this petition is disposed of reserving liberty to the petitioner to renew - 4 - HC-KAR NC: 2026:KHC:30609 CRL.P No. 6206 of 2026 his bail application subject to the outcome of Crl.P.No. 4252/2026.
