The accused/applicant has moved this first bail application under Section 483 of BNSS, 2023, for releasing him on regular bail during trial in connection with Crime No.137/2025 registered at Police Station – Kotwali, District – Dhamtari (C.G.) for the offence punishable under Sections 103(1) & 3(5) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the, “BNS”). 2. The case of the prosecution, in brief, is that on 05.06.2025 at about 11:00 p.m., deceased- Naresh Mali, objected to the applicant and two other co-accused persons bursting crackers near his house, which led to a dispute between them. During the quarrel, the applicant and the co-accused allegedly assaulted the deceased. It is alleged that co- accused- Hemant Som @ Pangadu stabbed the deceased with a knife, PRIYANKA VERMA Digitally signed by PRIYANKA VERMA Date: 2026.06.22 16:05:05 +0530 2 while the present applicant and another co-accused caught hold of him. Based on the said report, the police registered an offence against the applicant, leading to his arrest. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. He submits that the applicant has not committed any offence. He further submits that the applicant is in jail since 06.06.2025 and that the conclusion of the trial is likely to take some time, therefore, he may be released on bail. 4. On the other hand, learned State counsel opposes the bail application and submits that the applicant along with the other co-accused persons, caused the death of deceased- Naresh Mali and also injured other persons. He further submits that the eyewitnesses have supported the prosecution case and, therefore, prays for dismissal of the application. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, particularly the nature and gravity of the offence, and material available on record, I am not inclined to release the applicant on bail. 7. Accordingly, the bail application filed under Section 483 of BNSS, 2023 is rejected. 8.
