ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs: a. Direct the Respondent-1, SHO of Yeshwanthpur to register FIR considering cognizable offence details in the complaint, as petitioner Annexure-C dt: 20.04.2025 b. Permit petitioner to participate Police enquiry & concerned magistrate court through VC/WhatsApp/Zoom as petitioner currently working and living in Australia. c. Any other order as deemed fits this peculiar fraud on court case.
2. The petitioner and his tenants were illegally dispossessed on 13.06.2016 on account of improper execution of a delivery warrant due to the boundaries and measurements being improper. The petitioner pursued civil remedies, succeeded in the suit as also succeeded upto the Hon'ble Supreme Court of India, when the appeal filed by the decree holder came to be dismissed on 07.04.2025. It is pursuant thereto that the petitioner has registered online complaint on 20.04.2025 alleging illegal trespass into the property of

the petitioner which has been upheld by the Hon'ble Apex Court.
3. The contention of the petitioner now is that he also wishes to prosecute the criminal remedy by initiating criminal complaints for the criminal actions which complaint has not been taken on record by the respondent. The complaint filed by the petitioner indicating the offences, which have been prima facie made out in terms of the documents produced by the petitioner at Annexures-A1 to A8 to the complaint. It was but required for the respondent to register complaint, investigate the same and file a final report. Same not having been done, I pass the following:
ORDER i) The Writ Petition is allowed. ii) The respondents are directed to register FIR in terms of complaint filed by the petitioner within a period of seven days of the receipt of copy of this
order and investigate the same in accordance with law.
