Mr. Chiranjib Sinha. …for the petitioner Mr. Nilotpal Chatterjee, Mr. Debanjan Mukherjee, …for the KMC 1. In terms of the order dated 25.03.2026 and subsequently extended on 06.05.2026, the Corporation has filed a report in Court today dated 06.05.2026 duly signed by the Executive Engineer (C), Building, Borough IX and the same is taken on record. 2. The report records that in course of inspection in respect of three several premises being premises no. 37/5A/H/8, Kabitirtha Sarani, Ward 76; 37/4A/H/6, Kabitirtha Sarani, Ward 76 and 37/4A/1B Kabitirtha Sarani, Ward 76, since the owners could not produce sanctioned plan, proceedings under Section 400(1) of the Kolkata Municipal Corporation Act, 1980 have been initiated. Since, the Corporation has already taken steps, I am of the view that no fruitful purpose would served in keeping the writ petition pending. 3. Accordingly, the writ petition is disposed of by directing the Corporation to conclude the proceeding in 2 accordance with law and bring the same to a logical conclusion as expeditiously as possible preferably within 16 weeks from the date of communication of this order. 4. Since no affidavits have been called for from the respondents, the allegations made in the writ petition are deemed not to have been admitted by the respondents. 5. There shall be no order as to costs. 6. Let urgent Photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Raja Basu Chowdhury, J.)
