02/ 13.08.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Baliapur P.S. Case No. 58 of 2026, registered under 115(2), 195(1), 196, 299, 191(2), 191(3), 190, 121(1), 121(2), 324(5), 109, 132, 118(2) and 61(2) of BNS, 2023, pending in the Court of learned Judicial Magistrate, Ist Class, Dhanbad.

Learned counsel for the petitioner submits that scuffle took place between two groups during Ramnavmi festival process. He next submits that there are general and omnibus allegations against 100-150 unknown persons. He submits that petitioner has got no criminal antecedent which is disclosed in para 18 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of making hooliganism in the Ramnavmi festival process.

On perusal of F.I.R. it transpires that allegations are there against 100-150 unknown persons. There are general and omnibus allegations and what role has been played by the petitioner is not disclosed.

Further, the petitioner has got no criminal antecedent which is disclosed in para 18 of the petition.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Dhanbad, in connection with Baliapur P.S. Case No. 58 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
