Order No:-02 Dated:-18-08-2026
Heard the parties. The petitioner has been made accused in connection with Korrah P.S. Case No. 05 of 2026 registered for the offences punishable under Sections 318(4), 316(2), 336, 338 of the B.N.S., 2023 and Section 138 of the N.I. Act. Learned senior counsel for the petitioner submits that the allegation against the petitioner is that the petitioner took a private loan of Rs.83,75,520/- from the informant promising to make good returns within a period of six months but did not return the same and the period of six months was to be over by 31.01.2026 but before the period of six months, the case was instituted on 13.01.2026. It is next submitted that the allegation against the petitioner is false. Learned senior counsel for the petitioner relies upon the Order of the Hon’ble Supreme Court of India in the case of Raj Kumar Santoshi vs. Prashant Malik passed in Miscellaneous Application No. 1176 of 2026 in SLP(Crl) No. 5485 of 2024 dated 06.04.2026 and submits that therein, the Hon’ble Supreme Court of India has
observed that the courts should ensure that the proceedings instituted by such private money lender are nipped in bud, whether civil or criminal, unless the money lender at the threshold produces license for money lending or shows that money was not advanced by him at interest. It is next submitted that the informant does not have any license for money lending. It is then submitted that the dispute is at the most a civil dispute. It is further submitted that the petitioner has been in custody since 16.03.2026 as mentioned in para-09 of the instant bail application. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case and also undertakes not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State opposes the prayer for bail of the petitioner.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Hazaribagh in connection with Korrah P.S. Case No. 05 of 2026 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
