The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.711/2026 registered at Police Station Supela, District Durg Chhattisgarh for alleged commission of offence GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.06.23 15:39:12 +0530 2 punishable under Sections 75 (1) (ii), 75 (1) (iv), 79 and 351 (2) of BNS, 2023. 2. Case of the prosecution, in brief, is that an employee of the accused Employer Company lodged a complaint that the applicant used to harass the female employee working in the Firm and used to send obscene messages and used to talk with obscene words, when they objected regarding the same, the applicant threatened to terminate her Job, when this fact came to the knowledge of complainant, she verified with the other employees and they stated the same version. One present employee and another ex- employee of the FIRM supported the statement of the complainant. One said that she left the Job because of the Repeated Sexual harassment like obscene messages and demanded to meet her after the office timings by the applicant who is the CEO of the FIRM another employee alleged that applicant called her in the chamber and asked to touch the private part of his body in appropriate manner and also used to send obscene messages to her and demand sexual favours and the crime has been committed by the applicant. 3. Learned counsel for the applicant submits that the applicant resigned from Chauhan Auto Mobiles on 19th May, 2026 and got job in another Auto Mobile Company. It is stated that after two months of the incident, the present FIR has been lodged by the complainant who was working in Chauhan Auto Mobiles and she is not the victim. He further submits that no offence has taken 3 place and he has not outraged the modesty of the victim. He would submit that the applicant is ready to furnish adequate surety and shall abide by all the directions and conditions which may be imposed by this Court, applicant is a permanent resident of address mentioned in the cause title and there is no chance of his absconding, therefore he submits that the applicant is entitled for grant of anticipatory bail. 4. On the other hand, learned State Counsel opposes the prayer for grant of anticipatory bail and submitted that the applicant while working in Chauhan Auto Mobiles used to pass sexually coloured remarks against the ladies who were working there and FIR was lodged by one Amrita Singh who is the complainant of the case and as per 183 BNSS statement of the victim who was working under the applicant goes to show that the applicant used to call her in his cabin and wanted some sexual favours. It is further pointed out by the State counsel that the resignation letter itself goes to show that due to some personal reason, the applicant has resigned and it is not that because of some dispute regarding payment of salary he has resigned. He would submit that considering the nature of allegation against the applicant, he is not entitled for benefit of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, submission of learned counsel for the parties, materials available on record, 4 the statement of the victim recorded under Section 183 of BNSS goes to show that the applicant used to make sexually coloured remarks and wanted sexual favours from her, considering the nature and seriousness of the allegations levelled against the applicant and also considering the fact that investigation is still going on, I am not inclined to grant anticipatory bail to the present applicant. 7. 7. Accordingly, the anticipatory bail application of the applicant - Ankit Anand, involved in Crime No.711/2026 registered at Police Station Supela, District Durg Chhattisgarh for alleged commission of offence punishable under Sections 75 (1) (ii), 75 (1) (iv), 79 and 351 (2) of BNS, 2023 is rejected.
