Learned counsel appearing for the petitioner submits that apart from the statements of the co-accused, there are no other incriminating materials available against the petitioner. The petitioner has been falsely implicated in this case. 3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that the petitioner is a member of a gang which indulged in stealing of cars. This is an inter-state racket. There are several criminal antecedents against petitioner. At present I.O could lay his hands on nine such criminal cases, out of which five cases are of West Bengal and the four are of other States. Sophisticated techniques were used by the gang members. A relay switch has been 2 recovered from one of the co-accused. Apart from the statement of the co-accused and the criminal antecedents, there are phone call records for calls made amongst the accused. 4. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner. 5. Accordingly, the application for anticipatory bail is rejected. 6. The Superintendent of Police, Malda is requested to engage an Officer of the rank of DSP to investigate into the present case and similar cases involving the present petitioner. (Jay Sengupta, J.)
