Case of the prosecution, in brief, is that the complainant (Fuleshwari Bai Chauhan) lodged the F.I.R. at P.S. Mulmula, Dist.- Janjgir-Champa (C.G.) on 13.06.2025with the allegation that, one Mahesh @ Bundru Shrivas took her son namely Ajay Chauhan to get him some labour work and at around 04:30 P.M. she received a call from her sister's son Manish Chauhan who informed her that her son was found in bloodshed and was beaten badly by Sonu Yadav and Ajay Nirmalkar near the Wine Shop situated at Vill- Nariyara, thereafter Manish Chauhan along with his friend took Ajay Chauhan on his motorcycle to the Government Hospital Akaltara and from there he was referred to Apollo Hospital Bilaspur. That after questioning Ajay Chauhan, she got to know that on 13.06.2025 at about 04:00 P.M., he along with the applicant went to the Wine Shop situated at Vill-Nariyara, thereafter the co-accused Ajay Nirmalkar and the applicant Sonu Yadav subjected him to obscene verbal abuse, issued death threats, and intentionally caused him grievous chest injuries by striking him with a broken glass beer bottle. 3. Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 04/11/2025 vide MCRC No.8764/2025. He would submit that out of 18 prosecution witnesses statement of 6 prosecution witnesses have been 3 examined and 5 witnesses have turned hostile and injured witness is yet to be examined. He would submit that the applicant is in jail since 14/06/2025 and the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. From perusal of the records, it transpires that that this is the second bail application of the applicant and the first bail application was rejected by this Court on merits vide order dated 04/11/2025 vide MCRC No.8764/2025. Considering the fact that out of 18 prosecution witnesses statement of 6 prosecution witnesses have been examined and 5 witnesses have turned hostile and injured witness is yet to be examined which cannot be a ground to allow this second bail application. 7. Accordingly, the second bail application of the applicant- Sonu Yadav Alias Dedhiya, involved in Crime No.162/2025 registered at Police Station, -Mulmula, District Janjgir-Champa (C.G.) for the offence punishable under Sections 296, 351(3), 115(2), 3(5), 109 of BNS, 2023, is rejected. 8. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial expeditiously, preferably within 4 a period of four months from the date of receipt of this order in accordance with law, if there is no legal impediment. 9.
