Learned counsel for the petitioner submits that the petitioner is in custody in connection with Ketar P.S. Case No. 26 of 2026, for the offences registered under Sections 126(2), 115(2), 117(2), 109, 352, 3(5) of the B.N.S. 2023, pending in the court of learned Judicial Magistrate, 1st Class, Nagar Untari, Garhwa. 3. Learned counsel for the petitioner submits that although the victim is the informant of the case alleging that he and his wife has been assaulted, but there is general and omnibus allegation and the injury was found on the chest and abdomen. 4. Upon a query of this court, the learned counsel for the petitioner has submitted that investigation is still going on. 5. Learned counsel for the opposite party-State has opposed the prayer for bail and has submitted that there is direct allegation against the petitioner and injury on the chest cannot be said not to be an injury on the vital part of the body. The injury suffered is grievous in nature. 6. After hearing the learned counsel for the parties and considering the fact that the investigation is still going on and victim has suffered grievous injury on his chest as submitted by the learned counsel for the petitioner, this court is not inclined to enlarge the petitioner above named on bail.
