For Petitioner : Mr.K.Kharikharadas For R1 : Mr.B.Thanga Aravindh Government Advocate (Crl.Side) 1/5 https://www.mhc.tn.gov.in/judis ORDER This Criminal Original Petition has been filed by Accused No.5 in Crime No.31 of 2010, on the file of the first respondent Police Station, seeking to quash the charge sheet in C.C.No.242 of 2013 pending on the file of the learned Judicial Magistrate No.I, Tirunelveli. 2. A perusal of the charge sheet reveals that the petitioner has been charge sheeted for the offences under Sections 463, 464, 467, 468, 471 and r/w 420 of IPC. 3. A perusal of the complaint reveals that one Vasanthi, who is residing in Gujarath had lodged a complaint as against Accused Nos. 1 and 2 alleging that they have fabricated a No Objection Certificate for getting an electricity service connection to a property, which was owned by her father. Based upon the said No Objection Certificate, the fifth accused, who is working as a Technical Assistant in the Tamil Nadu Electricity Board is said to have undertaken the electrical work in the building. 2/5 https://www.mhc.tn.gov.in/judis 4. According to the learned counsel appearing for the petitioner, he had relied upon the No objection Certificate submitted by Accused Nos.1 and 2 and as an employee of the electricity board, he had acted in good faith and proceeded to give service connection to them. He has also relied upon the Section 168 of the Electricity Act 2003, wherein it is stated that no criminal action can be initiated against a public servant for acts done in good faith. He also relied upon the decision of this Court in Crl.O.P(MD).No.12789 of 2015 dated 30.10.2019, wherein under similar circumstances, the charge sheet laid against an employee of the Electricity Board has been quashed. 5. Though notice has been served upon the defacto complainant and his name has been printed in the cause list, he has not chosen to appear before this Court either in person or through counsel. 6. A perusal of the charge sheet clearly reveals that the petitioner is not aware of any forged or alleged fabricated document created by Accused Nos. 1 and 2. As an employee of Electricity Board, he had relied 3/5 https://www.mhc.tn.gov.in/judis upon the No Objection Certificate submitted by Accused Nos. 1 and 2 and proceeded to give the electricity service connection. Continuation of the proceedings against the petitioner would amount to harassment and it would be an abuse of process of law. 7. In view of the above said facts, the charge sheet in C.C.No.242 of 2013 pending on the file of the learned Judicial Magistrate No.I, Tirunelveli, stands quashed as against the petitioner alone.
