The factual matrix in the above two captioned writ petitions being the same, they were heard analogously and are being disposed of by this common order. In sum and substance, the reliefs claimed in both the writ petitions are identical. For the sake of convenience, W.P.(C) No.2680/2022 is treated as the lead case for deciding both the two petitions and in the said writ petition, the petitioners have prayed for the following reliefs : (i)The Hon'ble Court may kindly be pleased to call for the entire records, pertaining to order dated 24/12/2021 passed by the State Transport Appellate Tribunal, Raipur, Chhattisgarh in Appeal Case No. A 26/2021. ii The Hon'ble Court may kindly be pleased to issue a 3 writ of certiorari for quashing/setting aside the order impugned dated 24/12/2021 passed by the State Transport Appellate Tribunal, Raipur, Chhattisgarh in Appeal Case No. A 26/2021. iii Cost of the petition be allowed. iv. Any other relief, which this Hon'ble Court deems fit and proper under the facts and circumstances of the case. 2. The authorities of the State i.e. Secretary, Department of Transport and the Regional Transport Authority (RTA), Chhattisgarh, have preferred these petitions challenging the order dated 24.12.2021 passed by the State Transport Appellate Tribunal (STAT), Raipur, Chhattisgarh. By the said order, the STAT directed the RTA to pass appropriate orders within two weeks in respect of the application filed by respondent No.1 herein for extension of a permit granted earlier from Jagdalpur to Nagarnar on the basis of the time slot prayed for by respondent No.1. 3. Learned counsel for the petitioners/State submits that since there was no stay in favor of the petitioner-State, the permit applied for appears to have been granted to respondent No.1. Moreover, the period of permit has already expired and as such, these petitions have become infructuous by efflux of time. He submits that the State may granted liberty to file a fresh petition in case an exigency arises in future. 4. Considering the submissions advanced by the State Counsel, 4 these petitions are dismissed as having become infructuous. However, the State would be at liberty to file a fresh petition in case any exigency arises in future. 5. It is made clear that this Court has not expressed any opinion on the merits of the case, and as and when, a fresh petition is filed by the State, the same shall be decided in accordance with law.
