O R D E R This Writ Petition has been filed to direct the respondents 1 and 2 to cancel the patta issued in favour of the 3rd respondent vide Patta No.10504 for the lands in S.No.1712 of Vilpatti Village, Kodaikanal Taluk, Dindigul District and to effect patta in favour of the petitioner by considering her representation dated
14.08.2025. 2. The learned counsel for the petitioner submitted that the petitioner's husband was granted a conditional Patta in 1960, in recognition of his service as the Poosari. After the demise of her husband, the petitioner has been in possession and enjoyment of the property, and has been responsible for the temple and its rituals. The petitioner has no legal heirs, but subsequently has adopted one Mariammal, who now looks after the petitioner. It was further submitted that the father of the third respondent executed a sale deed on 18.09.1991 (Doc No. 816 2/5 https://www.mhc.tn.gov.in/judis
W.P.(MD)No.6314 of 2026 of 1991) in favor of one Santhanam. Upon the petitioner's husband highlighting an error in the survey number, a rectification deed was registered on 20.06.2002 (Doc No. 528 of 2002), in which the correct survey number, 1711/2, was specified, replacing the erroneous survey number, 1712. Although the third respondent's father has already rectified this error, the third respondent, exploiting the petitioner's illiteracy, poverty, and lack of family support, has now changed the patta to his name. The petitioner seeks the cancellation of the patta issued in the third respondent's name. 3. Heard the learned Additional Government Pleader appearing for the respondents 1 and 2. 4.
Considering the above, this Court directs the first respondent to consider the petitioner's claim after issuing notice to the petitioner as well as the third respondent and thereafter, pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. 1. 3/5 https://www.mhc.tn.gov.in/judis
