The present matter has been listed under the default category on account of failure on the part of the petitioner to affix the requisite ANURADHA TIWARI Digitally signed by ANURADHA TIWARI Date: 2026.01.22 13:23:53 +0530 2 Court fee on the affidavits. Affixation of proper Court fee is a mandatory procedural requirement and non-compliance thereof renders the pleadings defective and incapable of being taken on record. 3. The continued default reflects a lack of due diligence on the part of the petitioner in prosecuting the petition. This Court is of the considered opinion that indulgence cannot be extended indefinitely when statutory and procedural requirements are not complied with, particularly when the defect goes to the very maintainability of the pleadings. 4. In the above view of the matter, this Court finds that no useful purpose would be served by keeping the petition pending any further. Consequently, the petition is dismissed for default, with costs of Rs.2,000/-, which shall be borne by the petitioner and deposited in the Registry of this Court within a period of one week from today. The amount so deposited shall be remitted/transmitted to the Government School for Visual and Hearing Impaired, Tifra, District Bilaspur (C.G.). 5. Certified copies of the documents annexed to the petition, if any, shall be returned to learned counsel for the petitioner after retaining photocopies thereof on record.
