Grievance of the petitioner was noticed as under in the order passed in this writ petition on 09.09.2026:-
“Notice. Ms. Seema Sharma, learned Deputy Advocate General, Mr. Vishwajeet Singh and Mr. Balwinder Singh, learned counsel, appear and waive service of notice on behalf of the respective respondents. 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2
Petitioner’s grievance essentially stems out from the factum of non-registration of Diploma statedly passed by her in Operation Theatre Assistant training course from Sant Baba Bhag Singh Institute of Nursing, affiliated with Baba Farid University of Health Sciences, Faridkot. Let learned counsel for the respondents to have instructions in the matter. List on 10.09.2026.”
2. Pursuant to above, learned counsel for respondent No.4-H.P. Para Medical Council has placed on record office instructions dated 09.09.2026, inter alia, conveying that the petitioner had applied for registration with H.P. Para Medical Council in online portal of registration on 13.03.2023; Petitioner applied for registration with H.P. Para Medical Council in the online portal of registration again on 31.08.2023; Upon scrutiny and verification of the documents submitted by the petitioner, the Para Medical Council found that the petitioner had obtained a Certificate in Operation Theatre Attendant from Baba Farid University of Health Sciences, Punjab. Petitioner’s applications for registration with H.P. Para Medical Council were turned down on 31.05.2023 and 30.10.2023, respectively, on the ground that petitioner’s certificate course/diploma in Operation Theatre Attendant did not fall within the purview of H.P. Para Medical Council
3 Act, 2003 Schedule Para Medical Qualification. The office instructions referred to the Recruitment & Promotion Rules for the post of Operation Theatre Assistant notified on
09.03.2012. 3. Learned Senior Counsel for the petitioner submits that the aforesaid decisions statedly taken by respondent No.4 were never brought to the notice of the petitioner. Be that as it may.
In view of the stand taken by respondent No.4, the relief claimed by the petitioner on the foundation built in the instant writ petition cannot be granted to her. 4. At this stage, learned Senior Counsel for the petitioner sought permission to withdraw the writ petition with liberty to file afresh in accordance with law after incorporating appropriate pleadings and reliefs, inter alia, relating to the decision of the respondents. Granting such permission, the present writ petition is dismissed as withdrawn. Pending miscellaneous application(s), if any, also stand disposed of. Jyotsna Rewal Dua September 11, 2026
