WRIT PETITION No.12709 of 2026 ORDER: (Per Hon’ble Sri Justice A. Hari Haranadha Sarma)
The writ petitioner is the Creditor-Bank. The 2nd respondent availed loan in the said Bank. When securitization proceedings were initiated, 2nd respondent moved S.A.No.146 of 2026 and I.A.No.928 of 2026 for interim stay before the 1st respondent.
Pendency of the same and non-disposal by the 1st respondent is the grievance of the writ petitioner and the writ petitioner prays for direction to the 1st respondent to dispose of the I.A.No.928 of 2026, in a time bound manner. 2. Upon considering the assertions made in the petition and that the writ petitioner has filed counter-affidavit in the stay application and in view of the loan amounts involved, we deem it proper and justified to direct the 1st respondent to dispose of the stay application ie., I.A.No.928 of 2026 in SA No.146 of 2026, as early as possible, preferably, within a period of four (04) weeks from today, if it could not be disposed of on 05.05.2026, to which the matter is posted. 3. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
