for non-applicant/respondents No.3 & 4. Mr. Pankaj Sawant, Advocate vice, Mr. Sunil Kumar, Advocate, for non-applicant/respondent No.5. CMP No.23004 of 2026 in Ex.Pet. No.57 of 2019 in CWP No.623 of 2012 By way of this application under Order 1 Rule 10 CPC, a prayer has been made to bring on record the LRs of deceased Prakash Chand (petitioner No.4), whose details are given in the application.
Learned Counsel for the petitioners has drawn the attention of the Court to the legal heirs certificate appended with the application and has submitted that the applicants herein are the legal representatives of deceased Prakash Chand and they be substituted by deleting the name of the deceased Prakash Chand. In the light of the fact that there is no objection to the said application, the same is allowed, as prayed for. The name of deceased Prakash Chand is ordered to be deleted from the array of the petitioners. His legal representatives are substituted as
petitioners No.4a to 4c. Application stands disposed of. Amended memo of parties be filed.
CMP NO.19364 of 2026 By way of this application, a prayer has been made that the amount of Rs.700,000/- falling to the share of deceased Sh.Prakash Chand, be now ordered to be deposited in the account of newly impleaded petitioner No.4c Smt. Neela, wife of Late Sh. Prakash Chand. Learned Counsel submits that whereas petitioner No.4c Smt. Neela Devi happens to be the wife of late Sh. Prakash Chand, 4a and 4b are son and daughters, respectively.
Learned counsel for the petitioners has further submitted that in terms of the averments, which have otherwise been made in CMP No.23004 of 2026, both Gagan Thakur and Minakshi have given their no objection in case the amount of Rs.7,00,000/- is ordered to be deposited in the account of Smt. Neela Devi wife of late Sh. Prakash Chand and released in her favour. As there is no objection on the part of the non-applicants to the prayer as has been made in the present application and as there is no dispute that late Sh.Prakash Chand was entitled to Rs.7,00,000/- which now obviously have to be released in favour of his legal heirs, this application is disposed of with the direction that the amount of Rs.7,00,000/-, which was to be paid to Sh. Neela Devi is held to be solely entitled for being receiving the said amount.
